David Charles Weiss was born in Philadelphia, Pennsylvania, in 1956 and grew up in that city. He is the son of Meyer Weiss, who worked for the Internal Revenue Service in Philadelphia. Weiss completed a Bachelor of Arts at Washington University in St. Louis and earned a Juris Doctor from Widener University School of Law, preparing for a career in litigation and public service.

Weiss began his legal career in Delaware, serving as a law clerk to the Honorable Andrew D. Christie of the Delaware Supreme Court in 1984.
