Devendra Kumar Upadhyaya was born on 16 June 1965 in Ambedkar Nagar, Uttar Pradesh. He completed his legal education at Lucknow University, earning a Bachelor of Laws degree in 1991. His father, R.A. Upadhyaya enrolled as an advocate with the Bar Council of Uttar Pradesh on 11 May 1991 and began his practice at the Allahabad High Court. Early in his career he worked in the chambers of senior advocate Mohd Arif Khan, and in 1997 moved to the chambers of senior advocate S.K. Kalia. He practised primarily in civil and constitutional matters.
