Early life and background

Ayesha A. Malik was born on 3 June 1966 in Karachi, Pakistan. She completed early schooling in Karachi and abroad, including studies in London, and later returned to Pakistan for higher education. Malik earned a Bachelor of Commerce from the Government College of Commerce & Economics in Karachi and a Bachelor of Laws from the Pakistan College of Law in Lahore. She completed an LL.M. at Harvard Law School, where she was recognized as a London H. Gammon Fellow for 1998–1999.

Career

Malik began her legal career in private practice. Between 1997 and 2001 she worked at Fakhruddin G. Ebrahim & Co., and subsequently joined Rizvi, Isa, Afridi & Angell (RIAA). At RIAA she served as a senior associate from 2001 and became a partner in March 2004, leading the firm’s Corporate & Litigation Department and heading its Lahore office until her elevation to the bench.

Her courtroom work covered a wide range of forums, including appearances before High Courts, District Courts, Banking Courts, special tribunals and arbitration panels. Malik has also acted as an expert witness in family law matters in England and Australia, advising on issues such as custody, divorce and constitutional protections for women.

Malik moved into the judiciary in 2012 when she was appointed a Justice of the Lahore High Court on 27 March. During her tenure at the Lahore High Court she delivered rulings on several high-profile legal questions, including enforcement of international arbitration awards, election asset declarations and the use of invasive procedures in sexual assault investigations. In 2019 she was named president of a committee formed to protect women judges in Lahore following instances of misconduct by lawyers in district courts.

Her rulings at the Lahore High Court received significant attention; notably, she prohibited the so-called two-finger test in rape investigations, describing the procedure as invasive and without scientific value.

In January 2022 the judicial commission confirmed Malik’s nomination to the Supreme Court of Pakistan. On 24 January 2022 she took the oath as a Justice of the Supreme Court, becoming the first woman to sit on Pakistan’s apex court. Her appointment was welcomed by a range of civil society groups and rights organisations as a milestone for gender representation in the judiciary, though it also drew criticism from some quarters over the process used for elevation and questions about seniority.

Public profile

Beyond litigation and judging, Malik has been active as a legal educator and author. She taught Banking Law at the University of the Punjab and at the College of Accounting & Management Sciences, and developed a course on gender sensitization for court processes for the Punjab Judicial Academy. She compiled a handbook on environmental law to aid courts handling environmental matters.

Malik has provided pro bono legal services and counsel to non-governmental organisations working on poverty alleviation, microfinance and skills training. She has also volunteered as an English teacher at a school in Lahore.

Her written work includes publications on trade and financial services; she has written on judicial independence and secular legal principles in Pakistan, and contributed reporting to the Oxford Reports on International Law in Domestic Courts.
