Early life and background

Pankaj Mithal was born on 17 June 1961 in Meerut, Uttar Pradesh. He attended St. Mary’s Academy in Meerut and went on to complete a bachelor’s degree in commerce from Allahabad University in 1982. He then earned an LLB from Meerut College, affiliated with Chaudhary Charan Singh University, completing his formal legal education in 1985.

Career

Mithal enrolled with the Bar Council of Uttar Pradesh in 1985 and began practicing under Sudhir Chandra Verma. As a lawyer he handled civil matters, including land acquisition, rent control, education, labour and service law, and constitutional issues. From 1990 until his elevation to the bench, he served as standing counsel for the U.P. Avas Evam Vikas Parishad, Lucknow, and for Dr B.R. Ambedkar University, Agra.

He joined the judiciary and served a long tenure at the Allahabad High Court, first as a judge from 7 July 2006 until 3 January 2021. During his time there he took part in court administration, serving on committees such as the Library Committee, the Higher Judicial Services Committee, and a committee overseeing the construction of the High Court Museum. He also contributed to celebratory and commemorative projects, including work on the sesquicentennial Sub-Committee for Coins and Postage Stamps that guided issuance of commemorative coins and stamps marking the High Court’s 150th anniversary.

Mithal was appointed Chief Justice of the Jammu & Kashmir and Ladakh High Court on 4 January 2021 and served in that role until 13 October 2022. He then became Chief Justice of the Rajasthan High Court from 14 October 2022 to 5 February 2023. On 6 February 2023 he was elevated to be a judge of the Supreme Court of India.

Beyond courtroom duties, Mithal has chaired the State Advisory Board under the National Security Act while posted in Lucknow and has been involved with educational institutions. He has served as chairman of La Martiniere College (both boys and girls wings in Lucknow) and has been twice nominated to the Executive Council of Mahatma Gandhi Kashi Vidhyapith, Varanasi. He was also nominated to the Executive Council of Chaudhary Charan Singh University, Meerut.

Pankaj Mithal comes from a family with legal and public service connections. His father, the late Narendra Nath Mithal, served as a judge of the Allahabad High Court from 1978 to 1992; his mother was Vimal Mithal. A brother, Pallav Mithal, is described as a political science teacher. Other relatives include a grandfather who practised law and a paternal uncle who was also a lawyer.

Mithal has written on legal and institutional history and professional conduct. His works include an article on the history of the Allahabad High Court and pieces about the code of conduct for lawyers that were published in law journals and magazines. He is a trustee of Etawah Hindi Sewa Nidhi and of the Justice Narendra Nath Mithal Memorial Foundation, the latter established by his mother to support legal education, particularly for girls.

The judge has a noted personal interest in philately and stamp collecting, a hobby he has maintained since childhood.

Controversies

In 2021, the Communist Party of India (Marxist) wrote to the President of India seeking Mithal’s removal as Chief Justice of the Jammu & Kashmir and Ladakh High Court. The party objected to remarks he made while addressing a seminar organized by the Akhil Bharatiya Adhivakta Parishad, asserting those remarks were critical of elements of the Constitution. The matter was raised publicly by the party at that time.
