U. U. Lalit Biography

Uday Umesh Lalit is an Indian jurist who served on the Supreme Court of India and was the country’s 49th Chief Justice. Elevated directly from the Bar, he,

Early life and background

Uday Umesh Lalit was born on 9 November 1957 and grew up in a family with a strong legal tradition. His father, U. R. Lalit, practised at the highest levels of the Indian bar and served as an additional judge of the Delhi High Court as well as the Bombay High Court. Lalit attended Haribhai Devkaran High School and Junior College in Solapur before studying law at the Government Law College, Mumbai.

Career

Lalit enrolled with the Bar Council of Maharashtra and Goa in June 1983 and began practice at the Bombay High Court. He moved his practice to Delhi in January 1986 and worked in established legal circles, including time at the firm P. H. Parekh & Co and a period working with former Attorney General Soli Sorabjee from 1986 to 1992.

He was designated a Senior Advocate by the Supreme Court in April 2004 and appeared in a wide range of important matters before becoming a judge. During his years at the Bar he served as amicus curiae and as Special Public Prosecutor for the CBI in the trial linked to the 2G licence matter. His practice included representing prominent clients in high-profile criminal and civil matters.

On 13 August 2014 Lalit was elevated directly from the Bar to the Supreme Court of India bench, becoming one of the small number of lawyers in the Court’s history to make that transition. He served as a Supreme Court judge from 13 August 2014 until 27 August 2022. On 27 August 2022 he took oath as the 49th Chief Justice of India and served in that office until 8 November 2022.

Notable judgments

During his judicial tenure Lalit sat on a number of constitutionally significant benches. He was part of the Constitution Bench that declared instant triple talaq among Muslims unconstitutional. He contributed to rulings that read down provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act to permit anticipatory bail in certain circumstances, and to a decision clarifying when migrants should not be treated as members of scheduled castes solely because of state listings.

In criminal justice and procedural law he was part of a bench that directed installation of CCTV cameras in courts and court complexes in specified districts and clarified limits on access to those recordings under the Right to Information law. He also sat on benches that addressed family law—holding that the six-month waiting period for mutual-consent divorce under Section 13B(2) of the Hindu Marriage Act is not mandatory—and sexual offences under the POCSO Act, where the Court held that touching with sexual intent, even through clothing, can amount to sexual assault.

He led the bench that recognised the Travancore royal family’s management rights over the Sree Padmanabha Swami Temple, finding that the role of shebait and its heritable attributes supported that authority.

Public profile

Lalit belongs to a lineage of lawyers and grew up observing the practice of law in his family. Known for a personal lifestyle choice of teetotalism, he has also served in roles beyond adjudication: he was a member of the Supreme Court of India Legal Services Committee for two terms and became Executive Chairman of the National Legal Services Authority (NALSA) in May 2021.

Personal life

Lalit is married to Amita Uday Lalit; the couple married in 1986 and have two sons, Shreeyash Lalit, who is a lawyer, and Harshad Lalit. In June 2022 the couple participated in a tribal wedding ceremony in Araku, Andhra Pradesh. Lalit’s hometown is Mumbai, Maharashtra.

Latest updates

After a lengthy career at the Bar and on the bench, Lalit completed his service as Chief Justice in November 2022. His judicial record includes participation in several landmark and widely discussed rulings across constitutional, criminal and family law areas.
